1. Definition and subject of the contract
1.1 This contract (hereinafter referred to as the "Contract"), as a distance contract, is governed pursuant to art. 50 of Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). This contractual bond concerns the sale of movable property between Flo and Flo S.a.S, Via dei Cairoli 24 / r, 50131 Firenze, VAT number 04951730482 ("Flo and Flo") and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Flo and Flo of a purchase proposal issued by the Customer via the internet at the page www.floandflo.com ("Site") and / or through other remote sales systems of Flo and Flo, based on the methods described in the following art. 3.
1.2 These general conditions of sale ("General Conditions") and, in particular, the information referred to in art. 59 of the Consumer Code, as provided by Flo and Flo during the sale, repeated over the telephone to the Customer and reported on the Site, will remain valid and effective until they are modified and / or integrated by Flo and Flo. Any changes and / or additions to the General Conditions will be effective from the date on which they will be communicated to the public and will apply to sales made from that date. The latest updated version of these General Conditions is the one available on the Site.
2. Prices
2.1 The sales prices of the products illustrated during the sale, on the Site and / or through any other remote sales systems of Flo and Flo are inclusive of VAT and / or any other tax. Delivery costs are indicated during the sale, on the Site and / or through any other Flo and Flo distance selling systems.
2.2 The prices of all products are inclusive of VAT and / or any other tax. In addition to the price of the product at the end of the purchase process there may be the addition of the cost of shipping based on the customer's address.
3. Purchase and payment methods
3.1 The Contract is concluded at the time of payment, by sending the order confirmation to the customer.
3.2 In the case of purchase of custom-made products, the customer has 24 hours to withdraw from the contract and obtain a full refund, without any penalty and without specifying the reason. After 24 hours it will no longer be possible to cancel the order as the process of processing and creating the tailored garment will have begun.
3.3 The Customer will be allowed to choose one of the following payment methods: by credit card, prepaid card, PayPal or any other means of payment indicated as valid from time to time by Flo and Flo on the Site. No commissions will be applied to the Customer for any chosen payment method.
3.4 If the customer purchases several garments of the same product category for the first time, Flo and Flo will initially proceed to the packaging of a single garment (subject to agreement with the client), to verify the correct fit. As soon as this is confirmed by the customer, Flo and Flo will proceed with the packaging of the remaining items.
3.5 The creation of multiple profiles linked to a single natural person and / or relative set of anatomical measurements is prohibited. Any profiles that do not comply with this rule will be suspended. Any right of withdrawal / refund claimed on orders placed with irregular profiles will lapse. If discount codes have been used to make purchases from irregular profiles, payment of the amount relating to the discount applied will be required. In case of non-payment, the order cannot be shipped to the customer.
4. Delivery of products - complaints
4.1 The times required for the tailor-made garment are indicated when choosing the product. Flo and Flo delivers the products to the address indicated by the Customer within 15 days from the conclusion of the Contract *. During the creation of the garment, the Customer can be constantly informed about the status of the order by accessing the personal page on the Site (Account - Orders).
* Expected shipping date varies according to payment method and date of confirmation of anatomical measurements. During national holidays there may be any delays due to the closure of the establishments. Any variation in delivery times is communicated to the Customer by e-mail.
4.2 At the time of shipment of the goods, the Customer will receive an e-mail at the address indicated at the time of the order containing the tracking number with which to monitor the progress of the delivery.
4.3 If the Customer does not receive the goods or the shipment suffers undisclosed delays, the Customer can contact Customer Service by all the means indicated in the "Contact Us" section.
4.4 Each Flo and Flo product is made according to a specific non-industrial production process. This implies that a variation tolerance of 1 cm of the measurements of the garment made with respect to the specific measurements of the patterns is foreseen and allowed.
4.5 Flo and Flo constantly invests to offer a photographic representation of its products as realistic as possible. Despite this, due to the digital rendering of the images on the web, the various light settings of the screens or other external conditions, it is still possible that the representation of the online products does not fully conform to reality. By proceeding with the purchase, the customer accepts that there may be small discrepancies in this regard.

5. Customer Obligations
5.1 The Customer declares and guarantees: (i) to be a consumer in accordance with the provisions of art. 3 of the Consumer Code; (ii) to be of age; (iii) that the data provided by the same for the execution of the Contract are correct and truthful.
6. Right of withdrawal
6.1 The Customer has the right to withdraw from the stipulated Contract, without any penalty and without the obligation to specify the reason, within 24 hours of receipt of the order confirmation for custom-made products and 15 days for other types of products. The Customer may exercise the right of withdrawal, within the aforementioned terms, by expressing by telephone or by e-mail the will to withdraw from the contract. Once the production process of the bespoke and personalized garment has begun, it will no longer be possible to stop the process.
6.2 Pursuant to art. 59, second paragraph, of the Consumer Code, the customer has no right of withdrawal in the case of supply of tailor-made or customized products.
To guarantee a high level of service, Flo and Flo provides for the refund of the sum spent upon returning the purchased products within 15 days of shipment of the goods, if the packaged garment presents: structural imperfections * or impossibility of modifications.
* By "structural imperfections" we mean all the characteristics other than those foreseen by the order, or production defects that highlight differences with respect to the common sartorial canons (buttons not at a distance, non-compliant buttonholes, incorrect cuts, etc.).
In this case, the Customer is required to proceed as follows:
- send by e-mail to customercare@floandflo.com or by registered letter to the address below, 3 photos of the garment worn (seen from the front, side, back) so that the defect is visible.
- The complaint is reviewed by our Style Advisors, who will communicate any approval.
- The item to be returned must be boxed in its original packaging and sent at your own expense, together with the return approval form, with a traceable shipping method to the address:

Within 7 working days of receipt of the garment, the amount will be re-credited with the same payment method used at the time of purchase if possible (Credit Card on the website, PayPal). Otherwise, the customer must communicate the bank details on which he wishes to receive the refund in the Return Form.
6.3 Any product sent without following the above procedure will not be accepted and will be returned to the sender, without issuing any refund.
6.4 The object is returned intact (i.e. unused and complete with all original packaging and accessories).
6.5 Once the above conditions are met, the buyer has the right to be reimbursed for the full amount excluding shipping costs. Coupons or Discount Coupons used to purchase the garment will be replaced with new Coupons or Discount Coupons to be used for other purchases. The customer must return all purchased items, if they are part of a promotion, to receive a full refund. Any stored items will be charged at full market value.
7. Jurisdiction
7.1 The Contract is governed by Italian law.
7.2 Any dispute relating to the application, execution, interpretation and violation of the Contract will fall within the jurisdiction of the Court in which the Customer has his residence or domicile, if located in the territory of the Italian State, or of the Court of Florence, if the Customer has the their residence or domicile abroad.
